Steffans Legal Files Wage and Hour Class Action on Behalf of Wayfair Employees
On May 6, 2023, Steffans Legal filed a wage and hour class action against Wayfair, LLC in Suffolk County Superior Court. This class action alleges two wage and hour violations.
First, that matter alleges that Wayfair violated Massachusetts law by not providing employees with their final paychecks, including payment for unused vacation time, at the times required by Massachusetts law. Those times different depending on whether an employee resigns (check due in next pay period) or is let go involuntarily (check due on day of separation). Second, this matter alleges that Wayfair violated Massachusetts law by not paying call center employees for all hours worked, including time spent booting up and logging into their computers. Plaintiff has alleged that this time is considered “working time” under Massachusetts law and, accordingly, must be compensated.
